DUI Breath Testing in Pennsylvania

Throughout Pennsylvania, a number of different DUI breath testing devices are used.  Although blood testing is the most common method of determining DUI blood alcohol concentration in Pennsylvania, an attorney must be familiar with each machine that is used for breath testing.  Some of these DUI breath testing machines include the BAC Datamaster, Intoxilyzer 5000, Intoxilyzer 8000 and the Breathalyzer.

The prosecution must provide documentation showing the DUI breath testing device was in proper working order.  The operator of the breath testing machine must have been properly trained and certified.  The person tested must have been observed in order to ensure that alcohol did not enter the person’s mouth before testing.  Also, the DUI breath testing machine must have been operated in the proper manner.
