Did the cop ask you if you had been drinking alcohol or doing drugs?
Answer: Police are trained to get as much info from you as possible to help their investigation. The more you talk, the more you help the police, who are not your friends. Be courteous to the cops, and don't volunteer extra info. Ask to speak to a lawyer first before answering questions like these.

Did you do Field Sobriety Tests? (walk & turn, 1 leg stand, follow the pen)
Answer:These tests are not meant to be passed or failed, but to help the police build a stronger case against you. The tests ask you to do multiple things at once, and have flaws in them that a knowledgeable DUI attorney can expose and attack.

Were you given a blood or breath or urine test?
Answer: Blood, breath, and urine tests are the foundation of the State's DUI case. An experienced lawyer has substantial, detailed knowledge of the strengths and weaknesses of these tests as evidence. All test results can be challenged and fought.

Did you do a Portable Breath Test (PBT)?
Answer: PBT's are hand held breathalyzers police use to test your blood alcohol level on the spot. In Pennsylvania and New Jersey, PBT results are NOT admissible at trial. A person suspected of DUI/DWI is allowed to refuse them. Definitely consult a local DUI lawyer to learn your state\s laws.

Were you told your Blood Alcohol Level?
Answer: Your blood or breath alcohol concentration level (BAC) not only shows how intoxicated you might be, but what level of DUI you will be charged with. In most states, blowing over a .08 means you're DUI. In Pennsylvania and New Jersey, the BAC will determine the level of punishment if you are convicted.

Were you pulled over for a traffic violation?
Answer: The police can only pull you over if they have reasonable suspicion that you're committing a crime or a traffic violation. If you believe the cops pulled you over without a sensible reason, an experienced DUI lawyer might attack this point, try to get evidence suppressed, or your entire case dismissed.

Were you advised of the right to get an independent blood test?
Answer: In most states, people arrested for DUI have the right to obtain their own independent blood test. If you were not advised of your right, or if the police impeded your attempt to get an independent test, then you may have a strong issue for your lawyer to attack.

Were you involved in a collision / accident?
Answer: If you were involved in a collision & someone other than yourself was injured, you could possibly be facing felony (instead of misdemeanor) DUI related charges and possible prison time. Accidents up the ante and should only be handled by a lawyer.

Did you ask to speak to an attorney?
Answer: When the police question you, you have the right to request to speak to a lawyer before you answer any questions. If your request was refused or your request was ignored, make this known to your lawyer to include in your defense.

Were you read your Miranda rights/warning?
Answer: Once a police officer believes they have enough evidence and probable cause to believe you're driving under the influence, they must read you your "Miranda" rights before asking any incriminating questions. These are constitutional rights meant to protect your right not to incriminate yourself. If you weren't read your rights, make sure to let your DUI lawyer know to possibly aid your defense.
