A DWI in Mount Laurel Township is a Traffic Offense With Serious Consequences

In New Jersey, DWI is considered a traffic offense. Yet, the consequences of a DWI are extremely serious. If convicted of a DWI in Mount Laurel Township, a license suspension is certain and jail time is possible. In many DWI cases, an ignition interlock device will be ordered to be installed during the period of the license suspension and for additional time of 6 months to three years after the suspension period expires. Additionally, there are immense financial costs for a DWI conviction.

The Arrest by Mount Laurel Police or the New Jersey State Police

In Mount Laurel Township, the court process begins with an arrest for DWI and other related offenses. The police will keep the driver in the police station for twelve hours, unless someone signs for the release of the driver. A DWI ticket and other traffic tickets are issued with a date to appear in the Mount Laurel Municipal Court for an arraignment.

The Discovery Process

Kevin Leckerman, Esquire, a Mount Laurel DWI lawyer, will write to the Mount Laurel Municipal Court to excuse the appearance of the driver at the arraignment and will immediately send a request for DWI discovery (request for all evidence) to the Mount Laurel Township prosecutor. This letter will contain special requests concerning information about breath, blood or urine testing that occurred. If the requested discovery is not produced, then a motion to compel the production of discovery will be filed. Once this motion is granted by a Mount Laurel Municipal Court judge, then the prosecutor must provide the ordered discovery within a certain time period. If the prosecutor fails to provide discovery within the time period, the Mount Laurel Court could order that evidence be suppressed or the case dismissed entirely.

The 60-day Requirement in Mount Laurel

A rule of New Jersey courts requires that the Mount Laurel Court dispose of DWI cases within 60 days from the date of the arrest. This requirement is not always met. The discovery process may go well beyond the 60 days time period.

Once discovery is completely received, Mr. Leckerman will thoroughly review with his clients the defenses that will be used in the case. Mr. Leckerman will also discuss whether DWI experts should be retained to review technical or scientific evidence. Those DWI experts may be able to offer written opinions that could lead to the dismissal of the DWI charge in the Court.
